Scope
- These General Terms and Conditions (hereinafter „Terms“) of Waldgeister Dornstadt e.V. describe the contractual conditions that apply when a consumer or a business (hereinafter „Visitor“) purchases a ticket for the event of Waldgeister Dornstadt e.V. (hereinafter „Organiser“) named on the ticket. The house and site rules of the respective venue also apply. By purchasing and holding a ticket to an event, the applicability of these Terms is accepted.
- These Terms apply for the entire duration of the event named on the ticket, and the Visitor undertakes to comply with them. Individual agreements on the purchase of a ticket are excluded.
Applicable law & place of jurisdiction
- The law of the Federal Republic of Germany applies to the business relationships described below.
- The place of jurisdiction is the Local Court of Nördlingen, Tändelmarkt 5, 86720 Nördlingen.
Persons covered and points of contact
- A „Visitor“ within the meaning of these Terms is any natural person who enters into a legal transaction for purposes that predominantly cannot be attributed to their commercial or independent professional activity.
- A „Business“ within the meaning of these Terms is a natural or legal person or a partnership with legal capacity that, when entering into a legal transaction, acts in the exercise of its commercial or independent professional activity.
Conclusion of contract
- By purchasing the ticket, contractual relationships arise exclusively between the purchaser and/or holder of the ticket and the Organiser.
- The contract is concluded exclusively via the online portals verified by the Organiser or via suitable advance booking offices verified by the Organiser (hereinafter „Ticket Partners“). The verified Ticket Partners are listed on the event’s websites. The general terms and conditions of the respective Ticket Partner become part of the contract once the contract is successfully concluded.
- Sending the ticket by electronic or physical means constitutes acceptance of the contract by the Organiser. The ticket is only sent after payment of the purchase price. The Organiser reserves the right to transfer the processing of the contract to a Ticket Partner verified by it.
Right of withdrawal
- In accordance with § 312g para. 2 no. 9 of the German Civil Code (BGB), unless otherwise agreed, there is no right of withdrawal for contracts for the provision of services in connection with leisure activities if the contract provides for a specific date or period for the provision. Accordingly, a right of withdrawal is also excluded for contracts concerning the sale of tickets for leisure events tied to a specific date.
Cancellation & refunds
- An event may be cancelled. Visitors will therefore find all information regarding cancellation and programme changes on the event page in good time. Visitors are therefore strongly advised to check the event’s websites for current changes in good time before setting off.
- In the event of a cancellation before the event begins, the Visitor may demand a refund of the face value of the ticket. For online bookings the refund is processed via the Ticket Partner, for direct purchases via the Organiser itself.
- At events with several artists or groups, programme changes may occur. If individual artists (or groups) cancel, the Organiser will endeavour to find a suitable replacement; the Visitor has no claims arising from the cancellation of individual artists (or groups). For individual concerts, this claim only lapses if the essential character of the event is preserved, e.g. if the support act cancels.
- Access to event areas with limited capacity is only granted within the officially approved capacities. Once the capacity is exhausted, the Organiser may temporarily restrict access without this giving rise to a claim for a partial refund of the ticket price.
- For safety reasons the Organiser may temporarily or completely clear and cordon off individual parking and camping areas or other areas of the event grounds without this giving rise to a claim for a partial refund of the ticket price. The relevant instructions of the Organiser or of the persons and companies it has commissioned must be followed immediately in order to avert danger to life and limb.
- The Organiser reserves the right to interrupt or abandon the event at any time if visitors are potentially at risk. There is no claim to a refund of the admission price on the grounds of an interruption or abandonment for the avoidance of danger.
- The Organiser reserves the right to expel visitors who repeatedly fail to follow the instructions of the Organiser or its agents from part or all of the festival grounds. There is no claim to a refund of the admission price.
- The Organiser reserves the right to expel from the entire festival grounds visitors who riot, damage or steal property of the Organiser or of the companies and persons it has commissioned, or who injure, discriminate against or threaten violence towards other visitors, and to report this to the authorities. There is no claim to a refund of the admission price.
Ticket transfer
- The ticket can only be redeemed once and only on the date stated on the ticket at the venue stated on the ticket. The same applies to hardcover tickets – where available for the respective event.
- Personalised tickets can only be redeemed by the person printed on the ticket. Hardcover tickets – where available for the respective event – may be re-personalised at the entrance, taking account of legal requirements (e.g. for combating a pandemic) and in compliance with statutory data protection provisions (GDPR), and stored in the Organiser’s systems for a limited period under the legal provisions applicable at the time. During the re-personalisation process, the Organiser will explicitly inform the Visitor of the respective applicable legal provisions. The Visitor must consent to these. Should the Visitor refuse consent, redemption of the ticket may be denied. This does not constitute a withdrawal from the ticket purchase.
- Should the holder of a personalised ticket wish to transfer their ticket to another person, they may do so via the Ticket Partner’s online portal, provided this is permitted for the respective event. Fees may apply. Details of the transfer process can be found in the respective FAQ on the event’s websites.
- Commercial resale of event tickets is not permitted.
- Event tickets may not be sold privately at a price higher than the ticket price printed on them.
- A breach of these conditions results in the loss of the right of admission to the respective event without compensation. The event ticket becomes invalid.
Prices, payment and delivery terms
- Unless the seller’s item description states otherwise, the prices quoted are total prices including statutory VAT. For deliveries to countries outside the European Union, further costs may arise in individual cases for which the seller is not responsible and which are to be borne by the customer. These include, for example, costs for the transfer of money by credit institutions (e.g. transfer fees, exchange rate fees) or import duties or taxes (e.g. customs duties). Such costs may also arise in relation to the transfer of money if the delivery is not made to a country outside the European Union, but the Visitor makes the payment from a country outside the European Union.
- The payment and delivery option(s) will be communicated to the Visitor by the Ticket Partners.
Protection of minors
- Children and young people under 16 only have access to the event grounds when accompanied by a parent or legal guardian and at the latest until 22:00, under the conditions of § 5 of the Protection of Young Persons Act (JuSchG)
- Persons aged 16 and over have access to the event grounds until 24:00 at the latest, under the conditions of § 5 JuSchG. After 24:00, staying on the event grounds is only permitted when accompanied by a parent, legal guardian or a person entrusted with parental duties. A corresponding form setting out the delegation of parental duties must be carried at all times during this period.
Intoxicants and narcotics
- The consumption of alcohol is only permitted from the age of 16 and only under the provisions of the Protection of Young Persons Act, § 9 JuSchG.
- Children and young people are not permitted to smoke or purchase tobacco products. The provisions of § 10 JuSchG must be observed.
- The Act on the Protection of Young Persons in Public applies.
- In the event of a violation, the instructions of the Organiser or its agents must be followed.
- The consumption and sale of substances that are illegal within the meaning of the Narcotics Act is strictly prohibited.
Hygiene regulations
- The respective Infection Protection Measures Ordinance (BayLfSMV) of the State of Bavaria and the requirements of the Federal Republic of Germany apply. The exact implementation can be found on the websites of the respective event. Visitors undertake to comply with the applicable regulations and legal requirements.
Site rules
- The instructions of the Organiser and its agents must be followed without fail.
- The entire grounds and the facilities on them, such as the mobile toilets and washing facilities, as well as the surrounding meadows, woods and private land must be kept clean at all times.
Admission
- Admission to the event grounds as well as the car park and campsite is only granted with an event ticket that is valid within the meaning of these Terms. The ticket is deemed redeemed when the Visitor receives an access authorisation (e.g. an entry wristband) upon presenting it.
- Admission and re-admission are only granted with an undamaged access authorisation, e.g. in the case of an access wristband, if it is worn undamaged on the Visitor’s arm and shown unprompted at the entrance.
- It is up to the Organiser to check the validity of the access authorisation in individual cases.
Items brought along
- Bringing pyrotechnic items, torches, laser pointers and weapons (e.g. axes, baseball bats, chainsaws, etc.) is generally prohibited. Non-compliance will result in expulsion from the event grounds without any refund of the ticket value.
- Furthermore, bringing and using sound systems that go beyond standard car hi-fi equipment is prohibited. The stewards are entitled to confiscate sound systems brought along and to keep them for the duration of the festival.
- Operating music playback devices is strictly prohibited between 01:00 and 07:00. Violations will result in expulsion from the grounds. Use with headphones is exempt.
- A further security check takes place at the entrance to the event grounds. Security is authorised to carry out body searches.
- One 0.5l plastic bottle or Tetra Pak per person is permitted on the event grounds.
- Bringing professional photo, film, video and digital cameras as well as notebooks and tablets is generally not permitted. Audio, film, digital and video recordings, including for private use, are generally prohibited. Simple digital cameras without interchangeable lenses (no professional equipment, no film cameras) and privately used smartphones are permitted.
- The digital or non-digital distribution of any recording is completely prohibited. Misuse will be prosecuted.
- Distributing flyers, promo CDs, free samples, etc. is prohibited across the entire festival grounds without written permission. The sale and offering of goods of any kind (including food and beverages) is strictly prohibited across the entire grounds.
Campsite/car park
- Camping at the venue is only permitted on the areas designated as campsites and only with a valid access authorisation. The instructions of the stewards assigned for this purpose must be followed without fail.
- Camping on the surrounding meadows and woods or on private land is strictly prohibited. In the event of violations, a report by the respective landowners is to be expected.
- The opening/closing times of the campsite can be found on the event’s websites. The Visitor must park their vehicle and pitch any tent in such a way that obstruction of the emergency services is ruled out and access to the sanitary facilities is possible at all times. Escape and emergency routes must be kept clear at all times without exception.
- If the Visitor fails to observe these rules, the Organiser is entitled to remove incorrectly parked vehicles by suitable means at the Visitor’s expense and risk.
- Open fires are generally prohibited. Barbecuing in suitable fire bowls is permitted as long as they do not stand directly on the ground.
- Digging holes of any kind in the meadows or any other wilful damage is generally prohibited. Violations will result in expulsion from the festival grounds and a report by the respective landowners is to be expected. There is no claim to a refund of the admission price.
- Generators for producing electricity are not permitted. Security staff are entitled to confiscate them for the duration of the event.
- Glass bottles or glass containers are not permitted anywhere on the event grounds or on the parking and camping grounds.
Rubbish
- At events with camping or similar, rubbish bags are handed out free of charge at the ticket checkpoint. Rubbish can be handed in at the rubbish collection points at the respective times. Detailed information can be found on the event’s website or in the event programmes and flyers.
- Any disposal of bulky waste or other large quantities is prohibited and will be reported to the authorities.
- Environmental protection and the trust of the owners of the venues are the Organiser’s focus. Visitors undertake to leave their area on the event grounds as well as on the car park and campsite as they found it.
Pets and livestock
- Bringing pets or livestock is generally undesirable and is prohibited on the event grounds.
Disclaimer
- The Organiser has no influence whatsoever on the design, length and content of the individual performances.
- At music events, the volume may pose a risk of possible hearing damage and damage to health. Visitors are advised to take suitable hearing protection measures. Children under 14 are required to wear ear-protecting headphones on the event grounds. The Organiser accepts no liability for any hearing damage.
- Leaving and parking vehicles is at your own risk. The Organiser is not liable for damage caused by other vehicles, other visitors or other third parties.
- Use of the campsite is at your own risk. The Organiser is not liable for damage caused by other vehicles, other visitors or other third parties.
- The Organiser is not liable for items lost or stolen on the event grounds or on the car park and campsite.
